Text of QUESTION: Mr Christian Vanneste draws the attention of Mr Secretary of State to defence, charged with war veterans on the problem put down by the attribution of the premiums of " double campaign " to the war veterans of North Africa civil servants and assimilated, attribution for which the previous government requested the opinion of the Council of State. This one having returned its opinion, he thanks it for specifying him if the Government shortly intends to implement the concerned measure very waited by the combat world.
Text of ANSWER: Mr Christian Gal, general inspector of social affairs, accomplished a study in 2005 on the question of the possible attribution of the premiums of " double campaign " to the war veterans of North Africa, civil servants and assimilated. Its jobs allowed to hear all interested parties and to update available data on this complex question. It appeared necessary to have a supplementary legal lighting on some of its aspects. The Government then grabbed for opinion the Council of State. High jurisdiction returned its opinion on November 30th, 2006. She reminded first of all that it results from its contentious decision n 235 776 of April 5th, 2006 - national and professional Labour union of the Офисrs of merchant navy - that law n 99-882 of October 18th, 1999 relating to substitution, to expression in operations performed in North Africa , of expression in the war of Algeria or in battles in Tunisia and in Morocco , qualifying conflict in Algeria of "war" created a new legal status. She adds that the persons who participated in war operations, that is to say which were displayed to situations of battle in the course of the war of Algeria are likely to benefit from the double campaign. The Government sets therefore out to define the circumstances of time and of place allowing to identify the situations of battle which could open straight to such benefit. The Secretary of State in defence loaded with the war veterans will not miss to inform the parliamentary representation of the evolution of this file.
