Mr Christian Vanneste draws the attention of Mr State minister, minister of ecology, of energy, of sustainable development and of town and country planning, to the attribution of quotas CO2. The measure of quotas for plans described as new entrants to be envisaged currently is admitted to be deficient. To augment this reservation would be needed a bet to auction of 25 % quotas intended for thermal power stations over period 2008-2012. He would like to know which are the intentions of the Government on this subject.

Answer of the Government:

The reservation of quotas for the new entrants the national plan of allocation of quotas (PNAQ) on 2008-2012 includes, at the beginning of period, 2,74 Mt de CO2 a year. The inventory of plans corresponding to new entrants potentials and extensions of installation led to assess the needs of quotas in about 60 Mt by 2012. A sum of 9,26 Mt de CO2 a year in quotas would be so necessary beyond current reservation to cover needs estimated of quotas for the new installations and the increase of capacity. This official report is at this stadium to be modulated according to the effects of crisis, which remain difficult to assess. To avoid that reservation is showing a deficit and that the system penalises the new investments, the national plan of allocation of quotas has already envisaged the possibility, for the State, of acquiring quotas to abound reservation. The Parliament adopted, at the instigation of the Government, the article 8 of the corrected finance act of December 30th, 2008, which creates the count of called trade Management of active carbon of the State . This count redraws operations intended to adjust needs in units defined by the Kyoto protocol and the emission allowances of gas with greenhouse effect. This article also envisages the possibility of abounding the reservation intended for the entrants (RNE) new as part of PNAQ 2008-2012, by means of a sample on quotas appointed to the producers of electricity. The decree n 2009-231 of February 26th, 2009 withdrew the electricians 10 % quotas in as year 2009, that is 2,5592 million tons of CO2. This mechanism aims at clearing resources so that the State could acquire quotas on the market to re-feed, in the course of the water, the reservation of free quotas for the entrants new. The device was conceived in a flexible way and in a worry of perfect symmetry between existent installations and new entrants. The rate of reduction of the free quotas appointed to the electricians is fixed by decree on an annual base, according to needs real and cast by new plans: so, law contented itself with establishing percentages maxima of reduction on the free quotas of the electricians (-10 % in 2009, until - 20 % in 2010, - 35 % in 2011, - 60 % in 2012). Besides, the device is conceived in order to level the effort of the existent producers and of the new entrants, who will accept in fine the same percentage of free quotas in proportion to the needs. The Government so found the means to respect commitments taken in relation to the firms which develop plans on the national territory. Debates currently take place with the European Commission to finalise the concrete modalities of implementation of the article 8 of corrected finance act. Des discussions ont actuellement lieu avec la Commission europ enne afin de finaliser les modalit s concr tes de mise en oeuvre de l article 8 de la loi de finances rectificative.
